1. Agreement to these terms

These Terms & Conditions ("Terms") govern your use of https://highscalers.com (the "Website"), the free Missed-Call Leak Audit, any call you book with us, and our SMS / text messaging program (the "Messaging Program"). The Website and services are operated by HighScalers, a brand of Dawaris Technologies LLC, a Delaware limited liability company ("HighScalers", "we", "us" or "our"). By using the Website or joining the Messaging Program, you agree to these Terms.

2. About HighScalers

HighScalers helps independent US dental practices stop losing patients to missed calls, slow replies and no-shows. We set up and manage missed-call text-back, AI reception, appointment reminders and review requests for practices. Practice owners and staff can request a free Missed-Call Leak Audit or book a call with us through the form on our Website.

3. SMS / text messaging program

3.1 Program description

When you provide your mobile phone number on our Website form and check the matching consent box, you agree to receive text messages from HighScalers, a brand of Dawaris Technologies LLC.

Message types. The Messaging Program includes:

Service updates and appointment confirmations (non-marketing, first checkbox): confirmation of your Missed-Call Leak Audit request, updates about the status and delivery of your audit, appointment confirmations and appointment reminders for calls you book with us, and replies to your service-related inquiries.
Marketing promotions (second checkbox, optional): special offers, discounts and service updates from HighScalers. You receive these only if you separately checked the marketing consent box.

Operational intent. The Messaging Program is designed to ensure optimal customer support and to respond to your service-related inquiries quickly, for example confirming that we received your audit request, reminding you about a scheduled call and answering your questions.

Consent is optional. Consent to receive text messages is not a condition of requesting the audit, booking a call or purchasing any service. The phone number field on our form is optional, and both consent boxes are unchecked by default.

3.2 Opting out (STOP)

You can cancel the SMS service at any time. Just text 'STOP' to +1 (380) 324-6080. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

We also honor the replies QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE, and any other reasonable request to stop, including a request sent to [email protected].

3.3 Getting help (HELP)

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected] or +1 (380) 324-6080.

3.4 Message frequency and rates

Message and data rates may apply. Message frequency varies based on your interactions with our service.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive a varying number of messages depending on your interactions with us, typically a few messages around each audit request or booked call, plus marketing messages only if you opted in to them. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3.5 Carrier liability

Carriers are not liable for delayed or undelivered messages.

3.6 Age restriction

By using this service, you represent and warrant that you are at least 18 years of age. If you are under 18 years old, you may not use or access our services or opt into our messaging program.

3.7 Your phone number

You agree to provide only a mobile number that you own or are authorized to use, and to let us know if you change or give up that number by replying STOP from it or emailing [email protected].

5. The free Missed-Call Leak Audit

The Missed-Call Leak Audit is a free, no-obligation review of how your practice handles inbound calls, missed calls, replies and appointment follow-up. The audit is for informational purposes only. Any estimates of missed calls, lost appointments or revenue are good-faith estimates based on the information available to us and are not guarantees of future results. Requesting an audit does not create any obligation to purchase our services.

6. Paid services

If you decide to work with us, the scope, fees and terms of your paid services will be set out in a separate written agreement or proposal. If that agreement conflicts with these Terms, the agreement controls for the paid services.

7. Acceptable use

You agree not to misuse the Website, including by submitting false information, submitting another person's information without permission, attempting to gain unauthorized access to our systems, or interfering with the Website's operation. Please do not submit patient health information through the Website or by text message.

8. Intellectual property

The Website, the HighScalers name and logo, the tagline "Stop the leaks. Start scaling." and all content on the Website are owned by Dawaris Technologies LLC or used with permission, and are protected by intellectual property laws. You may not copy, modify or distribute them without our written permission.

9. Disclaimers

The Website and the free audit are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Website will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Dawaris Technologies LLC and its members, managers and employees will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Website, the free audit or the Messaging Program.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.

12. Changes to these Terms
